Buying real estate in Morocco as a foreigner

Can a foreigner buy a villa, apartment or riad in Morocco? Discover the main steps: land title, notary, financing, currency, Land Registry and precautions before signing.

Yes, a foreign national can acquire many types of real estate in Morocco. Whether it's an apartment in Casablanca, a riad in Marrakech, a villa in Tangier, or a second home, foreign real estate investment is recognized under Moroccan exchange control regulations.

But buying property abroad requires more checks than simply searching for a property. The land situation, the origin and traceability of the funds, the registration of the acquisition, and the exact status of the land must be verified before the transaction is finalized.

For an apartment, villa, riad or other conventional real estate, foreign nationality does not in itself prohibit acquisition.

However, agricultural land or land intended for agricultural use is subject to a special regime. It should never be considered the same as ordinary urban or building land.

What can a foreigner buy in Morocco?

🏢 Apartment A foreign buyer can purchase an apartment in Marrakech, Casablanca, Tangier or another Moroccan city, subject to the usual legal checks.
🏡 Villa Acquisition is possible. However, the location of the land, the land title, the existing buildings and their permits must be checked.
🕌 Riad A foreigner can acquire a riad in the Medina. For an older property, the analysis of the title, the surface area, and any alterations made deserves particular attention.
🏬 Local or commercial property Foreign investment can also involve real estate or real estate rights related to a business activity.
🌊 Secondary residence The acquisition of a pied-à-terre or a holiday residence is possible without the buyer necessarily having to become a Moroccan resident.
🌾 Agricultural Land Attention: Agricultural land or land intended for agricultural use is subject to specific rules for foreigners. A prior analysis of the land's status is essential.

📜 The land title: the first check

Before considering decoration, rental yield, or even price negotiation, the buyer must know what they are legally buying.

The National Agency for Land Conservation, Cadastre and Mapping — ANCFCC — manages, in particular, Land Conservation and land titles.

The property certificate attests to the legal and physical status of the building at the time it is requested. It therefore allows for verification of essential information relating to the property.

For a foreign buyer, this step should be part of the checks carried out with the professional responsible for securing the transaction.

The main steps of buying property in Morocco

Precisely define the property sought: City, neighborhood, use, budget, primary or secondary residence, possible rental and level of work must be determined before the search.
Identifying the owner and the status of the property: It is necessary to verify the identity of the seller, the land title, the legal status of the property and, when it is a plot of land, its exact purpose.
Have the documents analyzed. The professional in charge of the acquisition checks, in particular, the land registrations and the elements necessary for the preparation of the sale.
Structuring the Pre-Contract: A reservation or preliminary agreement should not be treated as a mere formality. Conditions, deadlines, financing, and necessary documents must be clearly defined.
Organizing financing and fund transfer For a non-resident purchaser, the origin of funds and their passage through the appropriate banking system are essential, particularly to preserve the rights attached to convertibility.
Sign the final deed and register the acquisition. The transfer must then be carried out in accordance with the applicable formalities with the Land Registry.

💱 Why is the source of funding so important?

The Exchange Office considers the acquisition of real estate or rights of enjoyment attached to such property as a form of foreign investment in Morocco.

When the investment is financed in foreign currency under the conditions provided for by the regulations, it benefits from the convertibility regime.

This regime is particularly important for a foreign investor since it guarantees, under regulatory conditions, the freedom to transfer income generated by the investment as well as proceeds from sale or liquidation.

In other words, the way in which the purchase is initially financed can have consequences several years later, at the time of resale.

It is therefore essential to keep bank statements and documents tracing foreign currency financing and to comply with the formalities for reporting the investment.

Can a foreigner borrow money in Morocco?

Exchange regulations provide for the possibility for certain non-resident foreign individuals to obtain credit in dirhams to finance the acquisition or construction of a residence in Morocco.

Minimum 30% The non-resident beneficiary must make a contribution in foreign currency of at least 30% of the price of the property to be acquired or built.
Credit guarantee The bank must have, up to the amount of the credit, in particular a first-ranking mortgage on the property or a foreign bank guarantee meeting the regulatory conditions.
Repayment of capital, interest and commissions must be repaid in accordance with the terms and conditions set out in the exchange regulations, in particular by means of foreign currency or a convertible dirham account.

Obtaining the financing is naturally subject to the bank's review of the application: income, creditworthiness, age, loan term, guarantees and the institution's risk policy.

🌾 Beware of agricultural land and land intended for agricultural use

This is probably the point on which a foreign buyer should be most vigilant when looking for a large property, estate or villa with a lot of land.

A large plot of land around Marrakech is not automatically a building plot freely accessible to a foreign buyer.

The legal status and intended use of the land must be verified before signing. Agricultural or agricultural properties located outside urban areas are subject to specific restrictions.

For certain non-agricultural investment projects , a non-agricultural vocation attestation procedure — AVNA — may be required.

The Casablanca-Settat Regional Investment Center indicates that a provisional AVNA (Agricultural Land Transfer Certificate) can make agricultural or agricultural-oriented property transferable to a foreign individual or a company with foreign capital, within the framework of a non-agricultural investment project. A definitive AVNA is then issued according to the applicable procedure.

This procedure should not be interpreted as an automatic guarantee of success. Each land application must be reviewed individually with the notary and, if necessary, the relevant authorities and councils.

Checks to perform before signing

📜 Land title: Check the owner, the property description, the registrations and its status with the Land Registry.
📐 Surfaces Clearly distinguish land area, built area, living area, terraces and outbuildings.
🏗️ Construction For a villa or a converted riad, check the permits and the status of the constructions and extensions.
🏢 Condominium For an apartment, examine charges, regulations, common areas and any outstanding amounts owed.
🌾 Nature of the land For a property with land, determine precisely its purpose and the rules applicable to the foreign buyer.
💱 Traceability of funds : Keep bank statements and supporting documents necessary for monitoring foreign investment.
💰 Taxation and fees : Calculate the duties, fees, registration fees and other costs applicable to the case before signing.
🔑 Future use Private residence, rental or tourist activity: check that the planned project is legally and administratively compatible with the property.

Paying a large sum too early.
Don't confuse enthusiasm for a property with legally securing the acquisition.
Rely only on a copy of the title.
The current status of the property must be verified as part of the transaction preparation.
Paying without arranging bank traceability.
For a foreign investor, proof of financing can be crucial in a future resale.
Assuming that a plot of land is suitable for construction.
Land, agricultural use, urban planning, and the right to build are different concepts.
Buying a guesthouse is like buying a regular house.
Operating a tourist business involves permits and obligations that must be studied separately.
Compare only prices per square meter.
In luxury real estate, land, architecture, location, condition and rarity can matter more.

The more atypical the property, the more thorough the due diligence must be.

For a villa of several hectares, an old riad, a property operated for tourism or a residence that has undergone successive transformations, it may be necessary to check several dimensions: land, urban planning, construction, operation, easements, equipment and taxation.

A spectacular property is only truly attractive when its legal and technical file is also sufficiently clear.
