Buying in Mozambique: Real Estate, DUAT and Foreigners

Can a foreigner buy a villa or apartment in Mozambique? Ownership of the buildings, right to use the land, DUAT, duration, transfer and checks: the essential points before committing.

Buying real estate in Mozambique requires understanding a fundamental principle: ownership of a building and the right to use the land on which it stands should not be confused.

The Mozambican system is very different from that which a French buyer is familiar with. The land belongs to the State and cannot be the subject of a classic private sale. Its use is based in particular on the Direito de Uso e Aproveitamento da Terra, more commonly referred to by its acronym: DUAT.

Is it possible to buy land in Mozambique?

The answer requires an important nuance: the land itself is not private property that can be freely bought and sold.

The Mozambican Constitution and land legislation establish that land belongs to the State. Therefore, it cannot be alienated, mortgaged, or given as security like land held in full ownership in some other legal systems.

This does not mean that no real estate rights can be held. The system is based in particular on the allocation of a right to use and exploit the land: the DUAT.

What is DUAT?

DUAT stands for Direito de Uso e Aproveitamento da Terra. It is the right to use and benefit from land under the conditions provided for by Mozambican legislation.

For economic activities, the land law provides for a maximum duration of 50 years. This right can be renewed for a further maximum period of 50 years, at the request of the interested party and in accordance with the applicable rules.

The DUAT is therefore not simply the equivalent of a French land ownership deed. It is necessary to understand precisely its nature, its holder, its duration, its purpose and the conditions attached to it.

Can one own a house or a villa?

This is where the distinction between the ground and the buildings becomes essential.

Land legislation allows for the transfer of existing infrastructure, buildings, and improvements on a plot of land, subject to applicable procedures and permits. In certain urban situations, the transfer of a building also entails the transfer of the right to use the corresponding land.

Thus, when an advertisement offers a villa, apartment or property in Mozambique, the buyer must determine precisely what is legally transferred : the building, improvements, associated DUAT and any other rights or permissions.

Can a foreigner acquire real estate in Mozambique?

Foreigners can participate in real estate and investment transactions in Mozambique, but access to land is subject to specific conditions.

The official APIEX guidelines state that foreign individuals wishing to obtain a DUAT (Duty of Access to Foreign Trade) are subject to residency and investment requirements. The official documentation specifically mentions residency in Mozambique for at least five years and, in the relevant cases, an approved investment project.

For legal entities, the conditions differ: the APIEX documentation is aimed in particular at entities constituted and registered in Mozambique, within the framework of the provisions applicable to investments.

Don't generalize. The statement "a foreigner can buy property in Mozambique" is too vague to guarantee a successful transaction. It's essential to determine whether the acquisition involves an apartment, a villa, a building with a DUAT permit, a tourism project, land for development, or a company structure. The rules and procedures will then differ.

How is a DUAT obtained?

When a plot of land does not already have a DUAT corresponding to the project, the procedure may include several administrative steps.

The investment procedure guide published by APIEX describes in particular the identification of the land, its survey, the filing of an application with the competent authorities, the local consultation and a period of publicity allowing for the expression of any objections.

The procedure and the competent authority depend in particular on the location, area and nature of the project.

What happens when a property is sold?

The transfer of a building must be carefully analyzed. According to land law, infrastructure, buildings, and improvements can be transferred by public deed, after authorization from the competent authority when required.

The transfer must also be properly registered and reflected in the relevant rights. In the case of an urban building, the law stipulates that the transfer of the building includes the transfer of the right to use and enjoy the corresponding land.

For the buyer, this means that it is not enough to verify that the house exists and that the seller claims to own it: the chain of rights and their registration must be checked.

What documents and elements should I check before buying?

Identity of the holder: Verify that the person or entity presenting the asset actually has the rights that they claim to be transferring.
DUAT: Verify its existence, its holder, its duration, its purpose and any conditions attached to the right.
Construction: Verify the ownership of the buildings and the consistency between existing constructions and available documents.
Registration: Ensure that rights, modifications and transfers requiring registration have been properly recorded.
Authorizations : For a project to be developed, check urban planning, construction, environment and any necessary licenses.
Site situation : Check the boundaries, actual occupation, access and the absence of rights or disputes incompatible with the project.

Beware of beachfront villas and private islands

Coastal properties require additional checks. An exceptional location never exempts you from verifying land, environmental, and administrative regulations.

For a private island, lodge or tourist estate, it is also necessary to examine the infrastructure, access, licenses, possibilities for expansion, water and energy supply as well as any constraints related to protected areas.

Buying in Maputo: apartment or villa?

In Maputo, the project may be more classic in its form: luxury apartment in Polana, villa in Sommerschield, residence near Costa do Sol or contemporary property in Triunfo.

But even in the capital, the Mozambican land tenure system must be taken into account. The buyer must also check the condominium regulations (if any), the fees, amenities, security, parking, and the overall condition of the residence.

What budget should I plan for when buying property in Mozambique?

The market is too heterogeneous for a national average price to be truly relevant. Apartments in Maputo, residential villas, properties in Vilanculos, lodges, and private islands all respond to different valuation logics.

Local due diligence before any commitment

For a foreign buyer, prudence dictates involving independent professionals capable of verifying documents before the payment of significant sums or the signing of a final commitment.

The verification must cover not only the seller and the construction, but also the DUAT, the authorizations, any charges, the registration and the compatibility between the purchaser's project and the rights attached to the property.

US international trade authorities also point out that obtaining and transferring DUATs can involve complex procedures and recommend that investors seek local legal expertise.
